German decision removes barrier to European Unified Patent Court

    

Power to resolve pan-European patent disputes does not violate German fundamental rights, court rules

The German Federal Constitutional Court has rejected two applications for preliminary injunctions that have been holding up German ratification of laws to create a European Unified Patent Court, meaning the patent court could finally be about to launch after years of delays.

Following ratification by other member countries, only German ratification stands in the way of the European Patent Office being able to start issuing Unitary Patents, which would protect intellectual property across 25 Europe countries via a single application and simplify the arbitration of pan-European patents. The Unified Patent Court would rule on disputes regarding the patents.
